OCTOBER 12-15, 2008 MEETING
SUMMARY REPORT 


Major Business and Actions
 The final rule hearing on amendments to the Florida Energy Code for
implementing the Governor’s Executive Order 127 directive to increase
building efficiency requirements by 15 percent was conducted. The
amendments will be implemented by the 2007 Florida Building Code
effective March 1, 2009.
  A rule workshop on amendments to the 2007 Florida Building Code, to
fix publication errors, unintended consequences of the new code,
conflicts between codes, etc, was conducted. The final hearing on these
amendments will be conducted at the Commission meeting December 10,
2008. The amendments will be posted on the Commission’s website for free
download and will take effect with the 2007 Florida Building Code on
March 1, 2009.  A rule workshop was conducted on education rule 9B-70 to
modify internet based forms required for course and course accreditor
approvals.  Adoption of the 2008 National Electrical Code during the
current code amendment proceeding was deliberated. The Commission
decided to conduct a due-diligence review of the new edition with a
target of July 2009 for its implementation.

Summary Report – Waivers

1. Eden Roc Hotel
Issue:  Accessible ramp from a hotel guest room to a balcony and all
levels within the room.’
Action:  Modifying action previously taken to include vertical
accessibility to all levels within the rooms.

2. Kamakura, Inc.
Issue:  Providing an accessible entrance to an existing building
undergoing an alteration.
Action:  Denied.  No additional response from applicant.

3. Cobb Theatre 14 at Daytona “Live”
Issue:  Vertical accessibility to all rows of seats in a 14 screen movie
theater complex. 
Action:  Approved.

4. Hollywood Theatres
Issue:  Vertical accessibility to all rows of seats in a new 14 screen
movie theater complex.
Action:  Approved.

5. Max Level’s Rock and Roll Academy.
Issue:  Vertical accessibility to the second floor. 
Action:  Approved. 

6. Duval County Public High School AAA
Issue:  Vertical accessibility to all rows of seats in an auditorium,
collapsible gymnasium bleachers, baseball and softball field bleachers
and football stadium.
Action:  Approved with conditions. 

7. 800 Ocean Drive
Issue:  Vertical accessibility to all levels in a restaurant and upper
floors in the hotel portion of the building. 
Action:  Approved for the café and dismissed without prejudice for the
hotel units.

8. Shops at Midtown Miami North Block Building.
Issue:  Vertical accessibility to the second floor of a showroom/office.
Action.  Approved.

9. Interior remodeling of Metrobank Operations Center.
Issue:  Vertical accessibility to the second level of an office area.
Action:  Approved for entire tenant space.
10. Muvico Theaters Cocowalk
Issue:  Vertical accessibility to all rows of seats in a stadium type
movie theater.
Action:  Deferred at the request of the applicant.

11. Florida International University Football Stadium Expansion.
Issue:  Vertical accessibility to all rows in a classroom setting.
Action:  Approved with conditions.

12. Florida International University College of Nursing
Issue:  Vertical accessibility to all rows of seats in two multi-tiered
classrooms.
Action:  Approved with conditions. 

13. Suncoast High School Replacement
Issue:  Vertical accessibility to all rows of seats in a tiered
auditorium.
Action:  Approved with conditions.

14. Lakeshore Reserve at Grande Lakes
Issue:  Vertical accessibility to the second floors of some townhouses
in a timeshare project.
Action:  Approved with conditions.

15. AMC Theatre at Tyrone Square
Issue:  Vertical accessibility to all rows of seats in a movie theater
complex.
Action:  Application withdrawn by applicant.

16. Wellington Community High School Auditorium.
Issue:  Vertical accessibility to all rows of seats in a tiered
auditorium.
Action:  Approved.

17. Brevard County High School CCC Football Stadium
Issue:  Vertical accessibility to all rows of bleacher and a press box. 
Action:  Approved.

18. Brevard County High School CCC Gymnasium Bleachers
Issue:  Vertical accessibility to all rows of a retractable bleacher
system.
Action:  Approved with conditions.

19. Brevard High School CCC Auditorium
Issue:  Vertical accessibility to all rows of seats in an auditorium.
Action:  Deferred for additional information.

20. Stockton-Myra Building
Issue:  Vertical accessibility and accessible toilets for the second
floor of a multi-tenant building.
Action:  Approved for vertical accessibility; dismissed for lack of
jurisdiction for toilets. 21. Primrose Schools.
Issue:  Mounting heights of fixtures in a child care facility.
Action:  Withdrawn at the request of the applicant.
