[Florida Code Talk] Licensed Subcontractors

Not if you agree to SUPERVISE them on RESIDENTIAL construction. F.S. 489.117 allows them to work under your license, on your residential construction project, under YOUR supervision. The same exemption is granted for commercial construction (489.113 if memory serves) as long as it does not conflict with local licensing laws or ordinances. Since all (to my knowledge) counties require comp-card or similar licenses for these trades, commercial jobs are not applicable.

BUT REMEMBER, "this exemption" does not apply to ALL subcontractor categories. Those defined in F.S. 489.105(3)(d)-(o) are NOT eligible, nor can any "SUB" (Division 2 contractor) use this exemption for their work. i.e., they MUST use employees or sub to LICENSED subcontractors.

This exemption carries vast legal responsibilities since you are statutorily "supervising" people. Check with your CONSTRUCTION ATTORNEY before undertaking such risk. You insurance policy should also be evaluated for coverage exemptions if you are going to undertake such responsibility.

Do subcontractors such as Drywall and Stucco subs working for licensed General Contractors need to be licensed?
