FEBRUARY 3, 2009 MEETING
SUMMARY REPORT 
 

Major Business and Actions
 
Rule Hearings on Repeal of Rule 9B-3.0477, Electrical Bonding of Pool
Decks; Rule 9B-3.0475, Wind Mitigation Retrofits; and, Rule 9B-3.0472,
Carbon Monoxide Detectors were conducted to eliminate interim rules
required by Florida law that are replaced by requirements adopted in the
2007 Florida Building Code, which takes effect March 1. 2009. 

The Commission voted to initiate a limited Code amendment proceeding to
adopt the 2008 National Electrical Code and amend administrative
sections of the Florida Building Code required by the settlement
agreement to the Interior Designers rule challenge. A rule development
workshop will be held at the April Commission meeting and rule adoption
hearing will be held at the June Commission meeting.

The Commission voted to initiate development of a rule for determining
cost effectiveness of energy efficiency requirement increases required
by statute for future Code amendments. 

The Commission voted to deny Power Steel Corporation's DCA08-BC-360
request for investigation of Cast-Crete Corporation's product approval
FL158 for possible non-compliance with state approval requirements.

ACCESSIBILITY CODE WAIVERS

1. Trademark Cinemas
Requirement:  Vertical accessibility to all rows of seats in a movie
theater complex undergoing an alteration.
Action:  Approved, pending verification that all accessible seats have
sight lines of 30 degrees or less.
 
2. Strike Industries
Requirement:  Vertical accessibility to second floor offices.
Action:  Approved as unnecessary and disproportionate to the cost of the
alteration to provide a lift to the second floor.
 
3. Magic City Casino
Requirement:  Vertical accessibility to all rows of stadium style
seating.
Action:  Approved as submitted.
 
4. North General Plaza
Requirement:  Vertical accessibility to the second floor of an office
building.
Action:  Approved until such time as a tenant is located and the second
floor is completed; elevator to be installed at that time. 
 
5. Green Monkey Yoga Studio
Requirement:  Vertical accessibility to the second floor of a multi-use
building.
Action:  Withdrawn at the request of the applicant.
 
6. Bayfront Park Amphitheater
Requirement:  Vertical accessibility to all rows of seats in an
amphitheater.
Action:  Approved, provided applicant submits revised drawings to ensure
wheelchair seating is not on the ends of the rows. 
 
7. Barnett Park Gymnasium
Requirement:  Vertical accessibility to all rows of seats in a bleacher
system. 
Action:  Approved, provided applicant submits revised drawings
integrating wheelchair seating into the bleacher system.

Issue: Use of a four hour rated fire wall to create fire areas less than
the 20,000 square feet limit at which fire sprinklers are required
throughout educational occupancies.
Final Action:  Approved prior action

Sections 507.2.2 and 507.2.8 of the 2004 Florida Building Code, Building
Issue: Whether double layer underlayment is required at 4 units on 12
roof slope.

Issue: Can Private Provider inspections be used for permitted work such
as air conditioner change-out.

DCA08-DEC-194 by Dan Arlington, St. Johns County Building Department
Section 1609.4.3 of the 2007 Florida Building Code, Building
Issue: Does the new requirement for 20% increase in uplift loads for
roof sheathing and roof-to-wall connections, for buildings located
within 600 feet of inland bodies of water that present a fetch of 1 mile
or more, apply to the entire load path and if so does it require 20%
increase in load capacity of the trusses.  
Action:   No. The 20% load increase is limited roof sheathing uplift and
roof-to-wall connection loads.

of Altamonte Springs
Rule 9B-3.0472, Carbon Monoxide Detectors
Issue: Requirement for CO detectors application to additions,
alterations, repairs and change of occupancy.
