A home owner has the right to terminate a contractor and the right to hire with out any ones permission. Larry Ballard, CBO, MCP Building Official City of Destin 4200 Two Trees Rd. Destin, Fl. 32541 PH:850-654-1119 Fax:850-837-7949 lballard at cityofdestin.com<mailto:lballard at cityofdestin.com> Member of BOAF (Buiding Officials Association of Florida) Saving lives and property since 1953 From: codetalk-bounces at myfloridacode.com [mailto:codetalk-bounces at myfloridacode.com] On Behalf Of Bob Koning Sent: Wednesday, November 25, 2009 11:39 AM To: Sam Nasser; codetalk at myfloridacode.com Subject: Re: [Florida Code Talk] Denial by BO I'm not a judge or lawyer or a Trier of facts - and neither is the building official. He or she must re-permit to another licensed electrical contractor. Also. The terminated Elec. contractor signed in his contract a clause stating "If for whatever reason the parties have a problem they cannot amicably resolve, the owner is hereby free to complete the job using another entity and the matter shall be resolved by mediation/arbitration or court with the loosing entity bearing associated expenses" Is this Building Official overstepping his authority by denying this? Is there such a state law that require release AFTER contractor is terminated? ________________________________ "Please Note: Florida has a very broad public records law.
