Major Business and Actions

 

The Commission conducted a Rule Development Workshop on Rule 9B-72,
Product Approval to change the number of products allowed on one
application. Considered and approved staff recommendation for the 2010
Florida Building Code development and adoption schedule (initiate
12/2009 and implement 1/2012). Selected the 2009 International Codes as
the "foundation" for the 2010 FBC. Approved certification to the US
Department of Energy that Florida's current energy code for commercial
buildings is 15% more stringent than the national standard designated by
DOE. Approved the report on Florida's Energy Code and regulated utility
company energy conservation programs to be transmitted to the Florida
Energy and Climate Commission.

1.	Urbana Retail Tenant Building 

Issue:  Vertical accessibility to n open air rooftop parking area. 

Action:  Amend action previously taken to have the Final Order reflect
the conditions that the applicant is to provide one additional parking
space on the roof and to petition the City to provide additional on
street parking. 

2.	 Winter Haven Fire Safety Complex 

Issue:  Vertical accessibility to the second floor of a fire station and
accessibility to firefighters toilet rooms. 

Action:  Deny, based on Department of Justice letter that all levels of
fire stations must be accessible.

3.	Dick Brown Park - Dave Manzo Field. 

Issue:  Vertical accessibility to all rows of seats in two bleacher
systems at a baseball field. 

Action:  Dismiss without prejudice for lack of sufficient information. 

4.	Italia Villa Hotel 

Issue:  Vertical accessibility to the second floor of a historic
building undergoing an alteration. 

Action:  Grant, based on demonstration of extreme hardship and negative
impact to the historic character of the building. 

5.	FAU/UF Joint Use Facility 

Issue:  Vertical accessibility to all tiers of seats in a university
classroom. 

Action:  Grant, based on demonstration of extreme hardship and technical
infeasibility. 

6.	Orange Bowl Field at Monroe Park 

Issue:  Vertical accessibility to all rows of seats in two bleacher
systems. 

Action:  Grant, based on technical infeasibility. 

7.	Marquis 

Issue:  Vertical accessibility to the cold plunge pool in a spa. 

Action:  Defer for additional information. .

8.	Miami Mar, Inc. 

Issue:  Vertical accessibility to the second floor. 

Action:  Grant, based on disproportionate cost. 

9.	Steven Sanders 

Issue:  Vertical accessibility to the second floor of an office
building. 

Action:  Defer for additional information.

10.	US Foodservice 

Issue:  Mounting height for visual fire alarms.

Action:  Dismiss for lack of jurisdiction. 

11.	1100 North Olive Avenue 

Issue:  Vertical accessibility to the second floor of an office
building. 

Action:  Grant, based on disproportionate cost.

Issue:  Vertical accessibility to tiered seating in two lecture halls.

14.	Michelle Hazen 

Issue:  Vertical accessibility to second floor offices.

Action:  Grant for modification of previously issued Final Order; based
on disproportionate cost. 

15.	Dino Laudati Salon 

Issue:  Vertical accessibility to a mezzanine. 

Action:  Grant, based on disproportionate cost. 

16.	Congo River Golf 

Issue:  Vertical accessibility to all holes of a miniature golf course. 

Action:  Grant, based on unnecessary and extreme hardship.

17.	University of South Florida - St. Petersburg Campus 

Issue:  Vertical accessibility to an exercise mezzanine. 

Action:  Grant, provided stairs are built that would accommodate
installation of a lift at a later date. 

18.	Palm Beach Ice Works. 

Issue:  Vertical accessibility to all levels of seating at an ice
skating rink.

Action:  Grant, provided two additional seats are provided at the rink
level and all accessible seats are located in the west mezzanine.

19.	South Walton Montessori Academy 

Issue:  Unknown.

Action:  Dismiss without prejudice for lack of information. 

20.	Gallop's Karate School/Crystal's After School Program 

Issue:  Vertical accessibility to the second floor. 

Action:  Grant, based on extreme hardship.

premixed lightweight cementitious mortar for hip and ridge roof tiles in
the HVHZ.

Action: Approved

DCA09-DEC-253 by C.S. Breslauer of Bermuda Roof Co., Inc     Action:
Dismissed 

DCA09-DEC-254 by Mike Harris of Sea Shutters Inc. - Clarify ASTM impact
resistant product test standard glass breakage criteria for porous and
non-porous products.          Action: Approved

DCA09-DEC- 257 by Mitch Thomas - Is a building permit required for
installation of low voltage, e.g. communications, systems.
Action: Approved with amendment.

DCA09-DEC-260 by Joseph Scofield, Advanced Manufacturing & Power System,
Inc. - Is a generator enclosure a building.          Action: Approved
with amendment.

DCA09-DEC-263 by Steven Clisset of Windstrips LLC - Does the Windstrips
new and innovative technology for attaching roofing underlayment qualify
for approval under the state product approval system.       Action:
Approved

First Hearings

DCA09-DEC-259 by Robert S. Fine Counsel for Malibu Lodging Investments,
LLC. - Does attachment of lightweight mural materials to existing
building facades require a permit.

Action: TAC recommendation approved and moved to second hearing.

Safety Action:  Referred back to TAC.
