Hello Mark, I assume your statement is that the Wall was built without a permit. Hence the Code Enforcement Department would cite the property for "Building a Wall with out a building permit per the requirements of chapter 1 as adopted by your governing body". It will then be upon the owner of the property under a Code proceeding to prove that the wall was built with a building permit. If no building permit is found then the owner has 2 options: 1-Remove the violation -or- 2- Submit a permit for the structure. If option 2 is chosen then the wall and corresponding support foundation would be required to meet the requirements of the FBC in affect at the time of permit application. Allot of times it is cheaper to remove the violation and rebuild then to keep the old stuff and remediate it to current code. If you, as an inspector, feels that the wall is a safety risk then you have the responsibility to notify the BO that governs this area. The BO can make the next call as what to do. But if you have a life safety concern the only way to CYA is to report it to the BO. The client or owner may not like it but it is the only way to handle an unsafe situation. The wall is already installed (illegally) with no tie to the slab rebar. What are the ramnifications of leaving it without a footer & should I just ignore it since it is already done ?
