[Florida Code Talk] CodeTalk Digest, Vol 54, Issue 12

Actually the Florida Building Code does address systems that are not a complete change out. It is found in chapter 13-101.6. Though only one part of the system is replaced the whole system must be matched. This can be accomplished by one of four means,

1. ARI (AHRI) data

2. Accredited laboratory (example ARL labs)

3. Mnufacturer's letter

4. Letter from registered P.E. State of Florida.

I hope this helps.

Steve

It is the A/C Companies responsibility to pull the permit and make sure their work complies with the current mechanical code.

Since the A/C company wants the client to pull the permit, it sounds like they may not be licensed.

What is the name of the A/C company?

The Airhandler most likely is mismatched, but AFAIK there is nothing in the mechanical code that says they have to be matched.

During a utility door inspection, our condo Board noticed that a unit
owner's air handler had been changed and City of Clearwater records
indicated that no permit was pulled. The Board mailed a notice to the unit
owner requesting that they contact their AC contractor and have them pull a
permit and request an inspection. If the AC Company didn't, the matter
would be forwarded to the City regarding unpermitted work.

Their AC Company told her that she (the unit owner) would have to go to the
courthouse to pull and pay for the permit. They also told the elderly owner
that they explained to her that the air handler wouldn't match the
condensing unit so to save money they had to install the air handler this
way. She doesn't recall that conversation.

She was a nervous wreck after her conversation with the AC company and wants
to know what to do. Once the Board forwards this to the City of Clearwater,
will she be responsible for the expense of the permit and any equipment
changes needed to pass the inspection? She is all alone and trying to sell
her unit so scared this will put a financial burden upon her and doesn't
want to confront the AC company anymore.

For safety, our Board frequently checks permitting due to the volume of
contractors working within the complex. This will probably occur again due
to the age of the AC units and the owners so would appreciate some local
inspector input.

Thank you,

Greg Hatfield

Sounds OK to me, but what does that have to do with Unlicensed contracting ? Sounds like something is missing. Is this a electrical project, or a full building ?. In order to be accused of unlicensed contracting, you would have had to work the project yourself, or something like that. What proof do you have that the permit holder was on the job full time, and not just pulling the permit and turning the reigns over to you ?. I would go to the building department and get their support in defending yourself against these allegations. They would surely know the permit holder and what is going on in their area.
