NOTICE:       The Commission’s Technical Advisory Committees will
consider proposed amendments to the 2009 International Code in Rule
Development Workshops during July and August 2010. The schedule of

Major Business and Actions at June 8, 2010 meeting:

 

The Commission approved the TAC rule development workshop process and
schedule for developing recommendations and the Commission’s rule
adoption hearing process for ruling on proposed 2010 Florida Building
Code amendments. Routine business was conducted as follows.

waiver analysis.

 

1.	Pine Creek Sporting Club

Issue:  Vertical accessibility to the upper levels of a tree house
structure.

Action:  Withdrawn at the request of the applicant.

2.	Superstein Building, 350 Euclid Avenue, Miami Beach

Issue:   Vertical accessibility to all three floors of a historic
building containing an apartment and 11 hotel units. Accessible guest
rooms provided on first floor.

Action:            Waiver granted.

3.	University of South Florida Basketball Training Facility, 4202
E. Fowler Avenue, Tampa

Issue:   Vertical accessibility to three rows of tiered seating in the
film room of a basketball training facility.  Accessible seating is
provided in the first row.

Action:            Waiver granted.

4.	Hollywood Golf, 6000 Universal Boulevard, Orlando

Issue:   Vertical accessibility to 9 holes of a new 36 hole miniature
golf course. The course is designed to permit persons with mobility
impairments to play nine holes of golf with alternate pin/hole
placements to provide the experience of playing a total of 18 holes in
both courses in the project.

Action: Waiver granted.

5.	Hernando Elementary K, 12124 Commercial Way, Weeki Wachee

Issue:   Vertical accessibility to all rows of seats in a collapsible
bleacher system in a gymnasium. Seven wheelchair seating locations are
provided on the first level of the bleachers.

Action: Waiver granted.

6.	Orange County Orlando Magic Recreation Center – Mildred Dixon
Site, 303 S. W. Crown Point Road, Winter Garden

Issue:   Vertical accessibility to all rows of seats in a retractable
bleacher system located in a new, $5,000,000 facility. The 213 seat
bleacher system will provide 6 wheelchair seating locations with
companion seats at the lower level bleachers.

Action: Waiver granted.

7.	Whispering Pines Center, 609 S. W. 89th Avenue, Miramar

Issue:   Modify the 18” maneuvering clearance at a doorway and to reduce
the size of a toilet room grab bar from 42” to 36” due to a structural
column in this existing facility.  

Action: Dismiss. Commission cannot waive federal requirement but
building official may make determination that compliance is “technically
infeasible”.

8.	Winter Park Community Center, 721 W. New England Avenue, Winter
Park

Issue:   Vertical accessibility to all rows of seats in a new
retractable bleacher system.  Current retractable bleacher system
provides accessible seating on first two rows.

Action: Waiver granted.

9.	Alpha Delta Pi Sorority House Corporation, 537 West Jefferson
Street, Tallahassee

Issue:   Vertical accessibility to the second floor of a 14,239 square
foot building that was constructed in 1970. Renovation is to a second
floor bathroom.

Action: Waiver granted.

10.	KIPP School, 1440 McDuff Avenue North, Jacksonville

Issue:   Vertical accessibility to all rows of an existing cast concrete
bleacher system in a former greyhound racing facility that is being
converted to a charter school interior auditorium.  Eight wheelchair
locations are provided at the top of auditorium.

Action: Approved with conditions.

11.	Kids Inc. Daycare Facility, 1410 West Indianhead Drive,
Tallahassee

Issue:   Vertical accessibility to platform levels in day care facility
located in a church 

Action: Approved with conditions.

12.	Florida State University – Johnston Building, 143 Honors Way,
Tallahassee

Issue:   Vertical accessibility to all rows of seats in a classroom
expansion of a building constructed in 1932. Classroom has 6 stepped
platforms with 95 fixed seats and 4 additional wheelchair locations at
top and bottom levels.  

Action: Approved with conditions.

13.	Soho Beach House, 4385 Collins Avenue, Miami Beach

Issue:   Vertical accessibility to second floor of historic hotel where
waiver had been granted for use of space as guest rooms but now space
intended to be used for offices.

Action:            Waiver approved.

14.	Greenview Hotel, 1671 Washington Avenue, Miami Beach

Issue:   Elevator with interior dimensions in compliance with the
current code for a historic building. 

Action: Waiver granted.

Second Hearings – Final

 

DCA09-DEC-259 by Robert S. Fine Counsel for Malibu Lodging Investments,
LLC. – 

Q:        Does attachment of lightweight mural materials to existing
building facades require a permit.        

Action:  Deferred

Q#1:    Do windows have to be tested in three samples in size,
configuration and glazing?.

A:        Yes. According to section 1714.6 a minimum of three
specimens/samples must be tested for the product in question.

Q#2:    As the testing laboratory agency for the State are we correct in
making such

determination as to what was tested is ample or not and is in
compliance.

A:        Yes. The test laboaratory is responsible to test according to
the applicable standards.

Note: The petitioner had variations on question #1. All answers were the
same.

A:        Yes. To the extent the system is a “custom /one of a kind” it
falls outside the scope of the optional state approval.  Approval may be
achieved through local building plans review and inspection.
