However, the intent of establishing the Commission was that technical code decisions would be left to the technical experts appointed to that body. This would remove the politics from code decisions. I would agree that is the theory of all commissions, serving the various agencies of the State. During the adoption of HB4181, and it's implementation by the Commission, there was extensive discussions by all the interested parties in the need to adopt a model code and not write our own unless there was a true Florida specific need. Sounds reasonable and appropriate, as it appears to be the intent behind the creation of commissions, "doing the leg work to provide recommendations to the legislature for appropriate action." The Commission was provided the authority by the legislature to address code changes that addressed the Florida specific need. Every time the legislature intervenes in the technical aspects of the codes, they undermine the authority that was granted to the Commission and the extensive vetting of technical decisions that occur on a national level during the model code adoption process. Well as you are well aware and contrary to some more "liberal" thinkers, we [the economy] are experiencing probably the closest we can to a depression without really being there. This in mind, I would have the opinion that the legislature in it's never ending infinite wisdom, are looking at ways to generate more revenue and sees the IRC implications as another deterrent or regulation that will ultimately depress or hinder the current lifeless status of development and construction in this State. And as you should well know, construction and tourism are the mainstays of State revenue. Lastly, when you criticize, Being of an opposing opinion can hardly be perceived as "critical." As a government official, I hope this is not a text book position you take with anyone of another perspective. I would hope that you would have the courtesy of identifying yourself with a signature like most others do. This takes to much space on the internet and is more ego based than of any substance. I like just discussing the issue. There also no need to develop an attitude (?) on the group I responded to your posting. How is that become the "group?" with your "Let's hypothesize some more." If you disagree, make a professional argument (Professional is in the eyes of the beholder. There are many professions and those holding professional positions within those areas. Are you supporting of the opinion that the position makes the individual? A title makes the person? that we can all respect. Respect, a powerful word and used loosely in many ways. Like income, honesty, trust......all to be earned. Now look what you have made me do, get off the subject matter. Why don't you come on over to the other side of the earth and really make some contributions. I'm sure you would appreciate your governmental, regulatory position after dodging IDF for a few months. Thing is, I can accept disagreement Mr. Apfelbeck, MPA, CFPS, CBO. It does not disturb me that others have the right to their own opinion and then attempt to turn it into a "professional, respect" issue. But thanks for your opinion, it really is o.k.. Anthony C. Circumvent, how is that? The legislature creates the statutes the FBC regulates. Let's hypothesize some more. If the legislature circumvents the authority of the Florida Building Commission and removes the IRC fire sprinkler requirement, ISO will drop all building departments one BCEGS class. So, if your jurisdiction is a 4, it will drop to a 5 if everything else remains the same. Something else to look forward to for us and higher insurance rates for our citzens courtesy of the legislature. It is just liable to be a Class 10 due to non-participation. As far as the value, for each class difference, a 1% difference in the property insurance applies to the property for the live of the structure. All other factors being the same, a property that is graded a class 2 will pay 5% less than a property that is graded a class 7. In addition, the BCEGS class is a factor in your jurisdiction's flood grading if they participate in the flood insurance program. The same class 2 to a class 7 BCEGS difference can create a significant difference in flood insurance rates. Lastly, the BCEGS is the only financial incentive that a local government has to provide resources to the building department. If you throw away ISO, you have lost a significant tool to assist you in justifying an efficient and effective building department. Anthony C.
